Pettit Kohn Attorney Brian Suba Obtains Summary Judgment on a Slip-and-Fall Case

Pettit Kohn Ingrassia Lutz & Dolin attorney Brian Suba successfully argued a Summary Judgment Motion in Los Angeles County Superior Court on behalf of a national retail client in a premises liability case.  The plaintiff alleged that she slipped on a large puddle of water in the gardening department of the store and required a total knee replacement as a result of the accident.  The plaintiff claimed the store was responsible for her injuries because an employee testified that he failed to place warning cones near the spill.  The store maintained that numerous signs and warnings were placed throughout the store warning of the potential of a spill and that the characteristics of the spill were an open and obvious condition such that no further warning was needed.

Mr. Suba argued that the store could not be responsible for an injury resulting from such an obvious danger that could have been observed with ordinary care.  Through tactical objections and a careful analysis of the pertinent law and facts, Mr. Suba made clear that no triable issues of fact existed, and the court granted summary judgment in favor of the retailer.  As a result, the plaintiff’s claims against the defendant were dismissed.  The Los Angeles team was pleased to deliver this result for the client, who was happy to get this matter resolved in their favor.
