Litigator Christine Boisclair Prevails in Arbitration on Behalf of Technology Client

Pettit Kohn Ingrassia Lutz & Dolin litigator Christine Boisclair earned a favorable ruling for her technology client in a consumer arbitration breach of contract case.  The Claimants entered into a business relationship with Respondent as hosts of a property.  While the property was being occupied, a third-party guest submitted a serious complaint involving privacy and safety concerns during the stay at the host property.  After investigating the complaint, the Respondents terminated the Claimants’ accounts and removed them from the online platform.  As a result, the Claimants alleged their accounts were wrongfully deactivated and demanded reinstatement of their host status, lost revenue, as well as emotional distress damages for the wrongful and early termination of their contract.

Pursuant to the contract, the Claimants brought a demand for arbitration.  The Respondent argued that its decision to terminate the hosts’ accounts were governed by the Terms of Service which allowed the Respondent to terminate the contract if there were safety concerns.  After a full day of arbitration, the arbitrator found that the Respondent was within its rights to terminate the host account and that the Respondent acted within the bounds of its contract.  Since there was no breach of contract, the claim was denied in its entirety.
