Pettit Kohn Prevails in Bakersfield, California
On December 18, 2015, Pettit Kohn Ingrassia & Lutz won a Motion for Summary Judgment for one of its large retail clients in Bakersfield, California.
Plaintiff claimed he slipped on a piece of plastic while trying to load a file cabinet into his cart. Plaintiff argued that the defendant did not adequately check its floor for hazards. Although surveillance footage captured Plaintiff’s incident, the video was inconclusive as to the condition of the floor prior to the incident. Relying only on Plaintiff’s testimony, Pettit Kohn persuasively argued that the evidence in support of Plaintiff’s claim was speculative and that Plaintiff could not demonstrate that the defendant was negligent.
