Andrew Smith Achieves Win on Motion for Summary Judgment

On February 28, 2017, Pettit Kohn Ingrassia & Lutz won a motion for summary judgment on behalf of a major retail client in an alleged assault and battery case.  Plaintiff alleged that after an argument with a sales cashier, the cashier physically assaulted Plaintiff causing her to fall to the ground and sustain significant injuries.  Through careful discovery and investigation, Andrew Smith, was able to determine that Plaintiff was the aggressor, initiated the physical contact with the sales associate, and fell to the ground as a result of her own momentum.  The Court determined that the major retail client was not responsible for Plaintiff’s injuries and granted summary judgment.
