Shareholder Bron D’Angelo Obtains Summary Judgment Victory in Traumatic Brain Injury Case
Pettit Kohn Ingrassia Lutz & Dolin shareholder Bron D’Angelo of their Los Angeles office obtained a summary judgment victory after Plaintiff brought product and premise liability claims against Defendants.
Plaintiff alleged he sustained a traumatic brain injury due to a defect in a high-speed rolling door that caused the door to come down onto Plaintiff’s head while the Plaintiff was entering the Defendant’s office.
Pettit Kohn was brought into the case after one of the Defendants, a Fortune 100 technology company, requested tender and defense from Pettit Kohn’s client, a leading property management firm. Upon acceptance of the tender and defense, the cross-complaint by Defendant against Pettit Kohn’s client was dismissed. Bron D’Angelo brought forth a motion for summary judgment based on lack of notice of a foreseeably dangerous condition.
The court’s initial ruling was a tentative denial of the summary judgment motion. However, during oral arguments, Mr. D’Angelo skillfully and successfully refuted Plaintiff’s arguments and the court overturned the tentative ruling and granted summary judgment in favor of the Defendant. The court agreed with Mr. D’Angelo’s argument that Plaintiff had alleged only a design defect for which the Defendant could not be responsible for as an end user. The court further agreed with Mr. D’Angelo’s argument that the Defendant did not have notice of a foreseeably dangerous condition as no previous incidents had occurred with the door. As such, the Defendant had no reason to believe the door would cause injury.
