Litigation Attorney Meghan Turner Wins Summary Judgment Ruling in False Imprisonment Lawsuit
Pettit Kohn Ingrassia Lutz & Dolin litigation attorney Meghan Turner successfully obtained a summary judgment on behalf of a national retail client in a false imprisonment case in the Los Angeles Superior Court.
Plaintiff claimed she was injured during an asset protection encounter on Defendant’s premises, alleging the retail employee used force to detain her during a routine receipt check, causing injuries. Plaintiff alleged battery, false imprisonment, and negligence stemming from the encounter. Defense counsel filed a demurrer to Plaintiff’s causes of action for the intentional torts of battery and false imprisonment. The court sustained Defendant’s demurrer, granting Plaintiff leave to amend her complaint, which she failed to do within the time frame provided.
Video of the incident demonstrated that Plaintiff was not detained and could not have suffered harm during a voluntary receipt check. As a result, Defendant filed a Motion for Summary Judgment. Plaintiff submitted no evidence and did not oppose Defendant’s motion. Ms. Turner successfully argued that the store was following standard business practices and that there was no detention or physical altercation with Plaintiff nor was there any wrongful conduct. The court granted summary judgment in favor of the retailer and Plaintiff’s claims against Defendant were dismissed.
