Pettit Kohn Ingrassia Lutz & Dolin Secures Major Win in Employment Litigation Matter
Pettit Kohn Ingrassia Lutz & Dolin is proud to announce a major victory on behalf of its clients in a highly contested employment litigation case involving claims of constructive wrongful termination, sexual harassment, and invasion of privacy.
The lawsuit, originally filed in 2022, alleged serious workplace misconduct following the disclosure of a private photograph taken after a consensual encounter between the plaintiff and a former coworker. Although Pettit Kohn’s clients were not named at the outset of the litigation, they were later added as defendants under a joint employer/alter ego theory.
This complex and sensitive case presented considerable challenges, including aggressive opposing counsel and multiple legal theories of liability. Prior to the hearing, Pettit Kohn filed a Motion for Summary Adjudication seeking dismissal of the claims against its clients and striking the prayer for punitive damages. The motion emphasized that our clients were never the plaintiff’s employers and had no involvement in the alleged conduct.
Under the leadership and strategic direction of Shareholder Christine Clark, Senior Counsel Kristin Kameen and Associate Kendall Garald finalized a compelling motion and argued the matter before the court. At the June 30th hearing, Kristin successfully argued against the plaintiff’s joint employer, alter ego, and integrated enterprise theories, making an affirmative showing of each defendant’s unique management and operations. Following oral argument, the court adopted its tentative ruling granting summary adjudication in favor of our clients.
