Pettit Kohn’s Jennifer Weidinger succeeds in a Motion for Summary Judgment
On April 16, 2015, Pettit Kohn Ingrassia & Lutz brought a successful Motion for Summary Judgment for one of its large retail clients in a premises liability action in Kern County, California. Plaintiff alleged that she suffered extensive personal injuries as a result of a slip and fall incident that occurred on Defendant’s premises. Plaintiff alleged that Defendant failed to clean a spill prior to her fall, and that she would require a wrist fusion surgery in the future due to the incident. Pettit Kohn successfully moved to have the case dismissed, arguing that Defendant did not create the spill, and did not have actual or constructive notice because the condition was created a mere 45 seconds prior to the incident. Jennifer Weidinger represented the client on Pettit Kohn’s behalf.
