Pettit Kohn Prevails on Appeal of Malicious Prosecution Action, Awarded Attorneys’ Fees and Cost

On October 4, 2013, Pettit Kohn Ingrassia & Lutz prevailed on behalf of its client, an attorney, who was sued for malicious prosecution, intentional infliction of emotional distress, and negligent infliction of emotional distress. Pettit Kohn prevailed on its anti-SLAPP motion arguing the plaintiff’s claims were time-barred. The Fourth Appellate District, Division One affirmed the trial court’s order in a published decision. This is the first published decision in the Fourth Appellate District, Division One addressing the application of the one-year statute of limitations to a malicious prosecution action against an attorney. Pettit Kohn’s client was awarded all costs, including attorneys’ fees, on appeal. Valerie Garcia Hong and Doug Pettit, members of the firm’s Appellate Practice Group, represented the client.
