Pettit Kohn Successfully Defends Retail Client with Motion for Summary Judgment

On May 12, 2014, Pettit Kohn Ingrassia & Lutz brought a successful Motion for Summary Judgment for one of its large retail clients in a premises liability action in Riverside, California. Plaintiff alleged that she suffered over $1,000,000 in damages as a result of a third party’s assault on Plaintiff that occurred on Defendant’s premises. Plaintiff alleged that she would continue to suffer psychological damages and need counseling for the foreseeable future. Pettit Kohn successfully moved to have the case dismissed, arguing that the third party criminal conduct that caused Plaintiff’s injuries was not foreseeable.
