Shareholder Damian Dolin Prevails at Trial After Insurance Company Declines Policy Limit Demand
Pettit Kohn Ingrassia Lutz & Dolin Shareholder Damian Dolin prevailed in a Personal Injury trial. The case involved a head-on automobile collision in San Diego County. The plaintiff, Mr. Dolin’s client, sustained a neck injury which would require future surgery. The defendant stipulated to liability, but disputed the extent of the injuries, asserting the plaintiff’s neck injury pre-existed the accident and that surgery was not necessary.
Plaintiff requested the $100,000 liability insurance policy limit prior to trial. The carrier declined to tender the policy limit. After a 4-day trial in the Vista branch of the San Diego Superior Court, the jury returned a verdict in favor of Mr. Dolin’s client in the amount of $344,553.50, well above the insurance policy limit.
