Los Angeles Team Wins Summary Judgment Motion In Premises Liability Action

Pettit Kohn Ingrassia Lutz & Dolin recently brought a successful Motion for Summary Judgment for one of its large retail clients in a premises liability action in Los Angeles County (Central Division), California.  In a slip and fall incident, Plaintiff alleged that she sustained multiple orthopedic injuries and required surgery, demanding over $300,000.

Pettit Kohn Shareholder Bron D’Angelo, with the assistance of associate Silvia Luna, argued that there was a lack of actual or constructive notice as the spill was created less than five minutes prior to the incident.  As a result, the court found no grounds for Plaintiff’s arguments against Defendant’s motion and ultimately granted summary judgment in favor of Pettit Kohn’s client.
