Litigation Attorneys Shannon Finley & Arash Yahyai Win Summary Judgment on Behalf of National Retail Client

Pettit Kohn Ingrassia Lutz & Dolin litigation attorneys Shannon R. Finley and Arash J. Yahyai successfully obtained a summary judgment on behalf of a national retail client in a slip-and-fall case in the San Bernardino Superior Court. 

Plaintiff brought suit on behalf of her son, a minor, claiming that her son was injured as a result of a slip-and-fall incident on Defendant’s premises.  Plaintiff alleged that there was a spill in the area of the fall and that the Defendant failed to clean the area or provide notification of the dangerous condition.

Video recording of the incident demonstrated that the Plaintiff’s son had tripped as a result of his own actions.  Based on this video evidence, Defendant filed a Motion for Summary Judgment.  Mr. Yahyai successfully argued that there was no dangerous condition at the time of the incident and that even if there was a dangerous condition, Defendant had no actual or constructive notice.  Thus, the court granted summary judgment in favor of the retailer and Plaintiff’s claims against Defendant were dismissed.
